By accessing or using LandXchange (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
LandXchange is a peer-to-peer marketplace that connects land sellers and buyers in South Carolina and surrounding states. We provide tools for listing land, submitting offers, and managing negotiations. We are not a licensed real estate broker, agent, or attorney, and nothing on this Platform constitutes real estate, legal, or financial advice.
You must create an account to list land or submit offers. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when registering.
Sellers are responsible for the accuracy of their listings, including parcel details, acreage, pricing, and disclosures. LandXchange does not independently verify listing information. Submitting an offer creates an expression of interest, not a binding contract. Any binding agreement between buyer and seller must be executed through a separate purchase agreement and closing process.
Creating an account and browsing listings is free. Listing fees and transaction fees, if any, will be disclosed clearly before you are charged. Current fee schedules are available on our pricing page.
You agree not to: post false or misleading listings; use the Platform for any unlawful purpose; attempt to circumvent our systems or fees; harass or defraud other users; or scrape or copy Platform content without permission.
By creating an account and providing your phone number, you consent to receive transactional text messages (SMS) from LandXchange related to your account activity, such as offer notifications and status updates. Message and data rates may apply. Message frequency varies based on your activity.
To opt out of SMS notifications at any time, reply STOP to any text message you receive from us. After opting out, you will receive a single confirmation message and no further SMS. To opt back in, reply START. For help, reply HELP or email us at hello@landxchange.com.
You may opt out of non-essential email communications by clicking “Unsubscribe” at the bottom of any marketing email. Transactional emails related to your account and active transactions cannot be opted out of while your account is active.
The Platform is provided “as is” without warranties of any kind. LandXchange is not responsible for the accuracy of listings, the conduct of users, or the outcome of any transaction. You use the Platform at your own risk.
To the maximum extent permitted by law, LandXchange and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including lost profits or data.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law provisions.
